Illinois is slowly re-opening for business under the Restore IL Phases and the legislature has passed that set out new requirements for essential businesses when opening or continuing to operate. Likewise, even though the Illinois Workers’ Compensation Commission withdrew the emergency rule that created a presumption that being in the workplace was the cause of a Covid-19 infection, the Illinois legislature passed HB 2455, which creates a rebuttable presumption that a worker contracted Covid-19 while working, if working for an essential business.
The potential impact is yet to be seen, but the National Council on Compensation Insurance released an early economic analysis showing a potential cost of $4.4 billion on employers. In fact, nearly twenty states have passed a presumption for workers’ compensation cases, but mostly limited it to first responders and health care workers.
